Terms of Service

1. Introduction

These Terms and Conditions ("Terms") govern your use of the Wake mobile application (the "App", "Service"), operated by Ruggiero Spera, doing business as "Wake Mobile", based in Italia. By using the App you accept these Terms in full.

2. Account

• You must be at least 16 years old to use the App.
• You are responsible for the confidentiality of your credentials and for all activity on your account.
• You must provide accurate information and keep it up to date.
• Wake may suspend or terminate accounts that violate these Terms or engage in abusive behavior.

3. User Content

By posting itineraries, photos, comments, ratings or other content ("Content"), you retain ownership of your Content but grant Wake a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, reproduce, distribute, reformat, publish and display the Content within the Service and in promotional material related to the Service. The license terminates when Content or the account is deleted.

You are responsible for the lawfulness of the Content you post. You may not upload material that: (a) is copyrighted by others without permission; (b) is defamatory, obscene, violent, discriminatory; (c) violates third parties' privacy; (d) is misleading or spam.

4. Wake Pro Subscription

• Wake Pro is offered in two billing periods: monthly (€ 5.99) and annual (€ 39.99), prices in force at the publication date of these Terms.
• Purchases are processed through the Apple App Store under Apple's standard rules. Charges occur on your Apple ID at the time of purchase.
• Auto-renewal: subscriptions renew automatically unless cancelled at least 24 hours before the renewal date. You can manage renewals and cancel anytime in iOS Settings → Apple ID → Subscriptions.
• Prices may change for new subscribers; existing subscribers will be notified with reasonable notice.
• Refunds: handled exclusively by Apple under App Store terms.

5. Premium ("signature") itineraries

• Some itineraries are published by verified Creators and available for purchase only.
• Purchases happen through In-App Purchase. Once paid, the itinerary remains available on your account.
• On each sale, Wake retains a service fee (typically 30% on the post-store net, 20% for invited creators). The rest goes to the Creator.
• Refunds: handled by Apple. In case of refund, access to the itinerary may be revoked.

6. Creator Program

• To become a verified Creator you must apply and meet the requirements of the Creator Program. Final approval is at Wake's discretion.
• Creators may receive payouts for premium itineraries sold, through Stripe Connect Express. Onboarding to Stripe (identity verification + bank account) is required.
• Payouts are processed monthly with a minimum threshold of € 25. Balances below the threshold roll over.
• Creators are responsible for their own tax obligations on earnings.
• Wake reserves the right to suspend or terminate Creator status for Terms violations or inadequate content quality.

7. Promo codes and discounts

Wake may issue promotional codes granting free access to Wake Pro or unlocking specific itineraries. Codes have a limited validity, are not stackable, and can be redeemed once per user. Codes are not exchangeable for cash.

8. Prohibited conduct

You may not:

• use the App for unlawful or unauthorized purposes;
• attempt to access areas or data not intended for you;
• reverse-engineer, decompile or otherwise extract source code;
• create multiple accounts to bypass limits or suspensions;
• sell, resell or transfer accounts or purchased content;
• use bots, scrapers or automated tools without written authorization.

9. Intellectual property

The trademark, logo, interface, design, source code and content published directly by Wake (excluding user Content) are the property of Ruggiero Spera or its licensors, protected by copyright, trademark and other intellectual property laws. No implicit license is granted.

10. Warranty disclaimer

The App is provided "as is" and "as available". To the extent permitted by law, Wake disclaims any implied warranty of fitness for a particular purpose, merchantability or non-infringement. Wake does not warrant that the Service will be uninterrupted, error-free or secure.

11. Limitation of liability

To the extent permitted by law, Ruggiero Spera will not be liable for indirect, incidental, consequential or punitive damages arising from the use or inability to use the Service. The Controller's total liability to you, for any cause, shall not exceed the amount you have paid to Wake in the last 12 months.

12. Changes

Wake may modify these Terms at any time. Material changes will be communicated through the App or by email at least 30 days before they take effect. Continuing to use the Service constitutes acceptance of the updated Terms.

13. Termination and account deletion

You may delete your account at any time from Settings → Delete account. Deletion removes all your personal data within the times stated in the Privacy Policy. Active subscriptions must be cancelled separately from the App Store.

14. Governing law and jurisdiction

These Terms are governed by Italian law. For any dispute that cannot be amicably resolved, subject to mandatory consumer-protection rules, the competent court is that of the Controller's place of residence. Consumers residing in the European Union may also use the European Commission ODR platform (ec.europa.eu/consumers/odr).
